StarletCasting, located in The Netherlands, hereinafter referred to as “StarletCasting”, acts as an intermediary and provides selection services for clients, including: models, extras, actors, promotional staff, sales personnel, content creators, stylists, makeup artists, and photographers. Unless otherwise agreed in writing, the following general terms and conditions apply to all situations in which the services of StarletCasting are used.

GENERAL TERMS AND CONDITIONS – STARLETCASTING



Article 1: Definitions

1.1. In these general terms and conditions, the following terms are defined as:
"StarletCasting": the private limited company StarletCasting, established in the Netherlands, reachable via [www.starletcasting.nl](http://www.starletcasting.nl);
"Client": any natural or legal person who enters into an agreement with StarletCasting;
"Model/Talent": any person or service provider proposed or supplied by StarletCasting, including models, influencers, presenters, actors, extras, stylists, photographers, etc.;
"Agreement": the agreement between StarletCasting and the Client concerning the provision of services and/or models/talent.


Article 2: Applicability

2.1. These general terms and conditions apply to all offers, assignments, and agreements with StarletCasting, unless agreed otherwise in writing.


Article 3: Services and Scope
‍
3.1. StarletCasting provides models (fashion, lifestyle, catwalk, youth, high-end), influencers & talent (influencers, presenters, actors, extras), and production services (casting, photography, videography, styling, etc.) for the fashion, media, beauty, retail, and luxury industries.

3.2. StarletCasting reserves the right to engage third parties when necessary to execute an assignment.


Article 4: Bookings and Contracts
‍
4.1. Bookings are made via phone or in writing through direct contact with our experts.

4.2. A formal agreement is prepared for each assignment, outlining the agreed terms.

4.3. Cancellations are only valid if confirmed in writing and are charged as follows:
‍
* Cancellation more than 72 hours before the start: no charge
* Cancellation between 72 and 24 hours before the start: 50% of the fee
* Cancellation within 24 hours: 100% of the agreed fee


Article 5: Code of Conduct for Models/Talent
‍
5.1. All talent must adhere to the following rules:
‍
* Professional behavior and respect for all parties involved
* Punctuality and advance notice in case of absence (at least 24–48 hours)
* No unauthorized publication of content or on-set materials
* Well-groomed appearance and preparation for the assignment
* The use of drugs or alcohol during work assignments is strictly prohibited.
* Misconduct or rule violations may lead to immediate termination


Article 6: Intellectual Property
‍
6.1. StarletCasting reserves the right to use all created content for promotional purposes.
‍
6.2. The client obtains usage rights to the delivered photos, videos, and content, including publication and reproduction rights, after full payment—unless agreed otherwise in writing.
‍
6.3. Models and talent may not distribute visual material before the project is completed and approved by StarletCasting.
‍
6.4. StarletCasting retains the right to be credited upon publication.
‍
6.5. Commercial use outside the agreed scope requires a separate licensing agreement.


Article 7: Payment and Rates
‍
7.1. All rates are agreed upon in advance based on the project type, duration, and services involved.
‍
7.2. Invoices must be paid within 14 days from the invoice date, unless otherwise agreed in writing.
‍
7.3. Late payments will incur 2% interest per month, with a minimum penalty of €50.
‍
7.4. In case of non-payment, StarletCasting may suspend or cancel the assignment, which will be treated as a cancellation within 24 hours.


Article 8: Force Majeure
‍
8.1. In cases of force majeure (such as illness, war, strikes, natural disasters, technical failures, etc.), StarletCasting is not obligated to fulfill the agreement.
‍
8.2. If third parties involved in the assignment invoke force majeure, this also applies to StarletCasting.
‍
8.3. StarletCasting will attempt to offer suitable alternatives but accepts no liability for consequential damages.


Article 9: Liability
‍
9.1. StarletCasting is not liable for indirect damages, consequential damages, or loss of profit.
‍
9.2. Liability is always limited to the invoice amount of the assignment.
‍
9.3. StarletCasting is not liable for the conduct of hired talent or external parties, unless in cases of intent or gross negligence.


Article 10: Privacy & Data Protection
‍
10.1. StarletCasting processes personal data strictly in accordance with the General Data Protection Regulation (GDPR).
‍
10.2. Personal data of models, clients, and talent will be treated confidentially and not shared with third parties without consent, unless legally required.


Article 11: Right of Retention
‍
11.1. StarletCasting is entitled to suspend the release of materials, documents, and/or content until full payment of outstanding amounts is received.


Article 12: Exclusivity

12.1. Talent is not bound by exclusivity unless agreed upon in writing in advance. In such cases, different rates apply.


Article 13: Transfer and Modification
‍
13.1. Rights and obligations from the agreement may not be transferred to third parties without StarletCasting’s written consent.
‍
13.2. Changes in the client’s legal structure, ownership, or name do not release them from obligations.


Article 14: Disputes and Applicable Law
‍
14.1. These general terms and conditions are governed exclusively by Dutch law.
‍
14.2. All disputes will be submitted to the competent court in the district of Rotterdam, unless StarletCasting chooses another court.


Article 15: Final Provision
‍
15.1. In all matters not covered by these terms, StarletCasting will decide. Any deviations are only valid if confirmed in writing.
